Busking Terms and Conditions

SOC-B1 Buskers may only use amplification that is battery operated. Mains voltage amplification and amplification powered by a generator is prohibited
SOC-B2 Buskers must keep all speakers and amplifiers within the activity area and within 1 metre of their performance
SOC-B3 Buskers must not have exposed or unsecured speaker or electrical cables on the ground
SOC-B4 Excessive amplification is not permitted. Loud acts may be asked to lower their volume or cease busking. AlburyCity reserves the right to impose a decibel limit on amplified sound in appropriate circumstances. The default is 5db above background noise level
SOC-B5 The use of political, religious, racial, sexually explicit or homophobic material that may be deemed unduly persuasive, offensive or discriminatory is strictly prohibited as determined by the NSW Anti Discrimination Act 1977
SOC-B6 Buskers must not undertake any act that could be considered a public nuisance such as the use of excessive noise, offensive or discriminatory language, or anti-social behavior
SOC-B7 Where a complaint has been received about excessive noise, level of noise amplification, music of a percussive or repetitive nature, or excessive duration of an act, particularly in relation to the proximity of that act to a place or work or residence, and the complaint is deemed to be justified, a busker may be directed by an authorised persons to cease busking
SOC-B8 Buskers must comply with directions issued by an authorised person who may at any time request a busker to cease busking if the performance is deemed loud or intrusive, or excessively repetitive, or is causing public inconvenience, or is likely to cause harm to the public or property
SOC-B9 Buskers must comply with directions issued by any authorized person and members of the Ambulance, Fire and any other Emergency Services
SOC-B10 Buskers must not unreasonably interfere with pedestrian flow or public amenities or cause obstruction to traders or delivery vehicles, including by way of encouraging audience formation in such a manner as to cause such interference
SOC-B11 In-lieu of required minimum 2.5 metre clear pedestrian path width, an agreed minimum width must be maintained at all times
SOC-B12 Buskers should be aware that the building line may be used for navigation by people with vision impairment
SOC-B13 Buskers must not interfere in any way with an approved event or activity
SOC-B14 Buskers must take all reasonable precautions to ensure the health and safety of the audience witnessing the performance
SOC-B15 Council’s street furniture is not to be used for the purposes of any busking activity
OC-B16 Buskers must ensure that public property is not damaged in the course of the performance
SOC-B17 Buskers must keep the site clean while they are working. Any litter associated with the activity is the responsibility of the applicant/permit holder and is to be removed at the completion of the activity on each day
SOC-B18 Site cleaning, restoration and repair and associated costs are the responsibility of the applicant. Any incidental costs associated with repair, cleaning or restoration of the area by AlburyCity, as a result of the activity will be sought from the applicant
GC-AA11 Busking is not permitted in any area adjacent to a residential premises

Please note: SOC = specific condition, B = busking, db = decibel.

The volume should be appropriate for leisurely audience entertainment.

  • Busker must be presented in a clean and appropriate manner.

Busker Agreement

  • To only busk in the Preapproved busking locations provided by Albury City Council
  • Not to solicit funds or undertake the act of asking, seeking or requesting money or goods from members of the public.
  • Not to use amplified music unless otherwise approved by Albury City Council
  • Be non – offensive during busking activities
  • Activity should be safe and accessible for the public. Should be of minimum disruption to pedestrian traffic, conduct of businesses, community safety and public amenity
  • Not have any potential impacts with nearby businesses, properties or community members.
  • Pre-approved locations are available on a first-come, first-served basis. If your preferred location is occupied by another busker, you must choose an alternative site for that time.
  • Permits may take up to 2 business weeks to be issued. Buskers are not permitted to perform across the pre-approved locations until a valid permit has been obtained.
